Jose Hernandez-Hernandez is being held without bond at the Northwestern Regional Adult Detention Center after police say he had sexual relations with a 13-year-old James Wood Middle School student.
"The investigation is ongoing, and further charges are pending," said Sergeant Frank Myrtle with the Winchester Police Department. "[Hernandez-Hernandez] has been charged with carnal knowledge and indecent liberties."
Hernandez-Hernandez was arrested at his home off Pall Mall Street in Winchester. According to search warrants filed in Winchester Circuit Court, the young girl's phone was obtained by a school official.
It is unclear how the official obtained the phone, or how the official came across evidence of the relationship. However, search warrants say the school official discovered pornographic images of the 13-year-old girl and Hernandez-Hernandez, and showed them to police investigators.
The search warrants also state that a complaint was filed with officials prior to the discovery of the pornographic photos, but it is unclear who filed the complaint, and whether or not it was filed through the school or police officials.
"I can tell you that they were acquaintances, known through the family. And I can tell you that we responded out to James Wood Middle School out on Amherst Street," said Myrtle. "It was determined through the investigation that the activities that were occurring were not occurring on school property."
Hernandez-Hernandez has a bond hearing Monday in Juvenile and Domestic Court.
