According to Washington County District Court records, Robert Allen Masser, 28, of 106 Randolph Avenue in Hagerstown is charged with second-degree rape, second-degree assault, and third-degree sex offense.
Records indicate on July 2, 2014 officers with the Hagerstown Police Department responded to Randolph Avenue. The woman told police she wanted to pick up items from a friend's house she had been staying at, later identified as Masser.
When the woman walked into the residence with an officer to gather her items, she yelled at Masser stating, "You raped me and all you say is hi," court records say.
After the incident, the woman advised police that about a month ago she was living with Masser, and had attended a party at his home. She told police she had a headache while at the party and Masser told her he "had a good way to cure the headache." The victim advised Masser crushed percocet and xanax and mixed the two together. The victim told police she took the mixture and fell asleep very quickly.
According to court records, the woman awoke in the middle of the night with Masser on top of her. She stated he began to have sex with her while she was half asleep. She told officers because of the mixture she couldn't do anything to help herself. The following morning, Masser admitted to the woman he had sex with her while she was asleep, records say.
Masser is currently being held at the Washington County Detention Center. His bail was revised by Judge Mark D. Thomas from $45,000 to $75,000 following a hearing Tuesday, July 15, in District Court. Masser faces up to a total of 40 years behind bars and a $2,500 fine.
A preliminary hearing has been scheduled at 8:30 a.m. for August 6, 2014.
