Wayde Smith is being held at the Washington County Detention Center without bond after being found guilty of a 2013 third-degree sexual assault charge, where he had sex with a 14-year-old girl.
The 16 year sentence also stems from another case where in 2011 he pleaded guilty to having a sexual act with a 7-year-old girl. He was on probation from that charge with a 6 year and 8 months sentence suspended.
If convicted, Smith could face up to 16 years for his current charges in 2013 and for violating his probation from his 2011 charge.
"He is a 24-year-old who had been befriended by the family father of the victim and unfortunately in December of last year he had an opportunity to be alone with her, and he took that to his advantage and ended up having intercourse with her," said Brett Wilson, prosecuting attorney.
His trial is set for October 28, 2014 pending a psychiatric evaluation. Smith is a registered sex offender.
