"[Deborah Smith] pled guilty to perjury, which is a felony and carries up to 10 years in prison, and she pled guilty to obstruction of justice," said
Smith was indicted on capital murder last August, and faced life in prison. It was then she testified to a grand jury she had no knowledge of the events surrounding her sister's death.
"It was the basis of that testimony that we amended the murder charge to a perjury charge in our plea agreement," said Mackall.
According to the Commonwealth’s Attorney’s Office, Smith admitted on Monday that her brother Timothy confessed to her that he hired Tony Sharpe to kill their sister.
Under the plea agreement, Smith will serve four to seven years on the perjury charge, and 12 months on the obstruction of justice charge.
"I think it was in her best interest, and the interest of the Commonwealth to enter into this agreement,” said Mackall, “given the facts of the case, given that she agreed to in the plea agreement to testify against any co-defendants. And the only co-defendant we have left is her brother."

According to reports, Timothy Smith allegedly hired Tony Sharpe to murder his sister Gail in order to gain custody of their ill-father who also had a $750,000 estate.
"The next step is we have a trial date set for Tim Smith on September 29,” said Mackall. Assuming Smith goes all the way to trial, “That's the next thing on the agenda."
Timothy Smith is facing life in prison for charges of capital murder, conspiracy to commit murder and use of a firearm in the commission of felony murder stemming from the homicide.
Timothy Smith's trial and all parties' sentencings are set for September 29, 2014 in Clarke County Circuit Court.
