FRANKLIN COUNTY, Pa. - A Pennsylvania man accused of killing his mother will no longer be facing the death penalty, according to Franklin County District Attorney Matthew D. Fogal.

Marcus Wallace is charged with first and second-degree murder, burglary, criminal trespass, and criminal mischief. After reviewing his mental health history, court officials believe the death penalty is no longer an option.

As we've reported, police say Wallace broke into his mother's Hamilton Township home in December 2009, and he beat her while she was in bed.

Consuella Wallace died about two months after he attack.

Court documents show police were able to match blood from the crime scene with Marcus' DNA.
