The opinion was ordered in Franklin County Court of Common Pleas Monday, according to Dusman’s attorney Jack Sharpe, of Sharpe & Sharpe LLP in
Sharpe said the court agreed with Dusman’s argument stating that her 2004 contract, which was set to automatically renew in July 2016, was in effect during the time she was let go last March.
Therefore, Dusman was denied the 150-day notice that should have been given to her, if her contract wasn’t being renewed.
Sharpe said the court called for Dusman’s immediate reinstatement, and it could happen as early as Tuesday. However, he did state there are still some unresolved issues that have to be decided, including figuring out exactly how long her term will be, and the exact date of when her term will end.
Sharpe said the court will have to go over two separate contracts, her original one that was unjustly ended, and a new one contract that would end sometime in 2017.
