Jury Finds Daniel Lee Herbert Guilty on Murder Charges

Jurors have found a Martinsburg man guilty in connection to the shooting of an 8-year-old girl and another man during last year's Fourth of July celebration at War Memorial Park.
MARTINSBURG, W.Va. - Jurors have found a Martinsburg man guilty in connection to the shooting of an 8-year-old girl and another man during last year's Fourth of July celebration at a local park. 

After almost an hour of deliberation on Thursday, jurors found Daniel Herbert, 29, guilty on two-counts of attempted first-degree murder, three counts of malicious assault, two counts of wanton endangerment with a firearm and one count of fleeing from law enforcement

As we’ve reported, police say Herbert injured the child and 26-year-old Gabriel “Ziggy” McGuire at War Memorial Park in Martinsburg on July 4, 2012. Herbert was previously found guilty May 29 of being a felon in possession of a firearm in connection to the shooting during a separate trial, and sentenced to five years in prison. 

Both the child and McGuire survived the shooting. 

Herbert’s sentencing on the murder charges is scheduled for Oct. 24, 2013 at Berkeley County Circuit Court at 2 p.m.
