Prelim Hearing Set for Man Charged in July 4 Shooting

MARTINSBURG, WV - The man accused of shooting two people, including a child, at War Memorial Park's Fourth of July celebration will go before a judge soon.

Daniel Herbert waived his preliminary trial on July 11th; it's been rescheduled for August 1.

Police say on July 4, Herbert opened fire, wounding Gabriel McGuire in the back and an 8-year-old girl in the legs. Both were taken to City Hospital with non life-threatening injuries.

"One of the guys pulled out a gun and started chasing this other guy and was shooting at him," says Christian Lopez, who saw the whole thing unfold. Witnesses say Herbert had been arguing with McGuire before the shooting. "They ran up the hill, he shot about five shots. Next thing I know a little girl I saw had been shot in the leg."'

After firing shots, Herbert led bystanders and police on a foot chase.

"He was moving fast," says Joe Cox. "I'm an old man. He's a young kid. I went a half a block. Then I let him go. He'd stop eventually."

Police say they were able to catch him within 100 yards.

Herbert faces several charges.
